• Quiz content is automatically generated and may not reflect the most current information
• We make reasonable efforts to review and verify content, but cannot guarantee absolute accuracy
• Content you input for quiz generation may be processed by OpenAI in accordance with their terms of service

6. User Obligations and Acceptable Use

7.2 User-Generated Content

When you create custom quiz content or submit materials to the Service, you:

• Retain ownership of your original content
• Grant us a worldwide, non-exclusive, royalty-free licence to use, reproduce, modify, and display your content for Service operation and improvement
• Represent that you have all necessary rights to the content you submit
• Agree that your content does not infringe any third-party rights

7.3 AI-Generated Content

Quiz questions and content generated by OpenAI technology through the Service are subject to OpenAI’s usage policies. We claim no ownership of AI-generated content but provide it to you under licence for personal educational use.

8. Payment Terms (If Applicable)

If you subscribe to a paid plan:

8.1 Subscription Fees

• Fees are charged in advance on a recurring basis (monthly or annually)
• All fees are exclusive of applicable taxes, which will be added where required
• Fees are non-refundable except as required by law or stated in our refund policy
• We may change subscription fees with 30 days’ notice

8.2 Payment Processing

Payments are processed by third-party payment processors. By providing payment information, you authorise us to charge your payment method for all fees incurred.

8.3 Cancellation

You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period. No refunds will be provided for partial subscription periods.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL Challenger (Financial Literacy) Limited, ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING FROM:

• Your use or inability to use the Service
• Any unauthorised access to or use of your data
• Financial decisions made based on Service content
• Any other matter relating to the Service

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE, OR £100, WHICHEVER IS GREATER.

10.4 UK Statutory Rights

Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under English law.

12. Termination

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Challenger (Financial Literacy) Limited regarding the Service and supersede all prior agreements and understandings, whether written or oral.

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions will remain in full force and effect. The invalid provision will be modified to the minimum extent necessary to make it valid and enforceable.
